Terms of Service

Welcome to SkyTracker ("we," "us," or "our"). By accessing or using skytracker.ai (the "Platform"), the SkyTracker hardware device, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. By creating an account, you represent that you meet this requirement and that the information you provide is accurate.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

3. SkyTracker Device & Open Source Software

The SkyTracker device software (the "Device Software") is open source and available under the MIT and/or Apache 2.0 licenses. These Terms do not restrict your rights under those licenses. However, your use of the Platform — including data synchronization, cloud features, and the SkyTracker Network — is governed by these Terms.

4. The SkyTracker Network

When you connect a device to the SkyTracker Network, you may choose to share your ADS-B data publicly, keep it unlisted, or make it private. By selecting "public" or "unlisted," you grant us a worldwide, non-exclusive, royalty-free license to aggregate, display, and analyze that data as part of the Service.

5. ADS-B Data & Limitations

ADS-B data received and displayed by SkyTracker is sourced from publicly broadcast radio signals. This data is provided "as is" and may be incomplete, delayed, or inaccurate. SkyTracker is not an air traffic control service. You must not rely on SkyTracker for aviation safety, navigation, or operational decisions.

6. Subscriptions & Billing

Certain features require a paid subscription (Pro or FBO). Subscriptions are billed monthly or annually via Stripe or Apple In-App Purchase. You may cancel at any time; access continues through the end of the current billing period. Refunds are handled per the applicable payment provider's policies. Promotional codes grant access for the duration specified and are non-transferable.

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or to track aircraft for harassment, stalking, or surveillance of individuals.
  • Attempt to interfere with, disrupt, or overload the Service or its infrastructure.
  • Reverse-engineer or scrape the Platform (the API is available for authorized use).
  • Misrepresent your identity or impersonate another user.
  • Share your account credentials or allow unauthorized access to your account.

8. Intellectual Property

The Platform, its design, branding, AI models, rarity scores, and proprietary features are owned by SkyTracker and protected by intellectual property laws. The Device Software is separately licensed under open-source terms. Nothing in these Terms grants you rights to our trademarks or branding.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ADS-B DATA WILL BE ACCURATE OR COMPLETE. SKYTRACKER IS NOT LIABLE FOR ANY DECISIONS MADE BASED ON DATA PROVIDED BY THE SERVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYTRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless SkyTracker, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Platform. Continued use after changes take effect constitutes acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may delete your account at any time through your account settings.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
